These conditions of sale are concluded on the one hand by the company La Colline aux Savons registered with the chamber of trades under number 901 305 102 00013 code APE 2042Z, whose head office is located at 2 Chemin des Monneries, 16320 COMBIERS and on the other hand, by any natural or legal person "the buyer" wishing to make a purchase through the commercial site www.lacollineauxsavoirs. fr, whether the buyer is a professional or a consumer.

 

Acceptance of terms

 

 The buyer acknowledges having read, at the time of placing the order, the special conditions of sale set out below and expressly declares to accept them without reservation.

These general terms and conditions of sale govern the contractual relationship between La Colline aux Savons and the buyer, both parties accepting them without reservation. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation.
La Colline aux Savons reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

Characteristics of the goods and services offered

 

The products and services offered are those listed in the catalog published on the website www.lacollineauxsavoirs.fr

These products and services are offered within the limits of available stocks.
Each product is accompanied by a description drawn up by
  Soap Hill.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered. Each product is handcrafted so yours may be slightly different from the photos shown on the site (non-contractual photos).

Due to the artisanal process of cold manufacturing soaps, their weight may vary depending on their drying time with a tolerance of + or - 5g.

Product availability

  Soap Hill undertakes to do its best to ensure the availability of its products. If a product is not in stock between the time of your order and the management thereof, you will be informed by email or telephone as soon as possible. You will have the choice between refunding or replacing the missing product.

 

Your guarantees

 

Satisfied or refunded (14 day period). You have a right of return of 14 days after receipt of the package to return it to us, in its original packaging, and obtain a refund or exchange. Returned products must be unopened and undamaged.
During this period, the package return guarantee is total: no justification will be required. For any returned item that you have paid for, the following terms apply:
 - The package has been returned unopened: refund of the package and any shipping costs.

 - The product is returned simply because you are not satisfied: refund of the product, return costs at your expense.
 - The product is returned for a reason that is the responsibility of  Soap Hill : reimbursement of the product, any shipping and return costs.
 
To process your requests, we kindly ask you to specify your first and last name, address, order date and order number. We will not be able to take into account any incomplete requests. The return of parcels must be made to the following address:

The refund will be sent to you according to your method of payment, transfer or PayPal, at the latest in 14 days after receiving the products.

 

Withdrawal period

 

You have a period of 14 working days from receipt during which you can refuse the order. In this case, before any return of goods, contact us systematically for validation. Any merchandise used by the customer will not be taken back or exchanged.

The deadline for the return of products by the customer is 14 days from the day on which the latter notified the  « The Soap Hill of its withdrawal (Art. L.121-21-3 of the Consumer Code) .

The return of the order must be made in the original packaging with a copy of the invoice. The cost of transporting the returned goods will be your responsibility. The refund is made within 14 days after receipt of the returned goods, and verification of its condition. (Art. L.121-21-4 of the Consumer Code).

The rates
 

The prices indicated in euros are net  Soap Hill not being subject to VAT (the prices invoiced are exclusive of tax, VAT not applicable, art.293 B of the CGI).

The prices can be modified at any time without notice, the articles being invoiced on the basis of the existing tariff on the day of the registration of the order.

Transport and delivery costs are calculated and added at the time of the order at the expense of the buyer.

The online sale of products and services presented on the site is reserved for buyers who reside in France and in the Dom-Tom.


Processing your order and delivery
 

Your orders are processed as soon as possible. Packages are prepared upon receipt of payment. 
The products are delivered by La Poste Colissimo or Mondial Relay to the address indicated by the buyer on the order form and only to the geographical areas that we serve.

In the event of damage to the package during transport, the customer must refuse the package to the postman (or carrier) at the time of delivery of the Colissimo. The exchange of any product declared, a posteriori, damaged during transport, without any reservation having been issued upon receipt of the package, cannot be supported.

As in any expedition, it is possible to suffer a delay or that the product gets lost. In such a case, we contract the carrier to start an investigation. Every effort is made, as long as necessary, to find this package. If necessary, the trader will be reimbursed by the carrier and will deliver a new identical package at his expense. We decline all responsibility for the extension of delivery times due to the carrier, in particular in the event of loss of products, bad weather or strikes.

Shipments generally take place within 72 hours of receipt of payment for your order, excluding exceptional breaks and holiday periods.

Your order is generally delivered in 2 to 3 days by La Poste Colissimo, 3 to 5 days in the Mondial Relay relay of your choice (you will receive a confirmation request from your relay when preparing your package)

These deadlines are in working days, excluding postal delivery problems and subject to product availability.

Delivery times are only given as an indication if they exceed thirty days from the order, the sale may be canceled and the buyer reimbursed.

Participation in shipping costs for metropolitan France is calculated automatically according to the weight of your order.



Payment

An invoice for your order will be sent to you by email and on paper in your package.

Payment of the full price must be made when ordering online by the buyer. At no time can the sums paid be considered as a deposit or down payment.

All orders are payable in euros, all taxes and mandatory contributions included.

To pay for his order, the buyer has the following payment methods: Bank card or PayPal, under the conditions detailed below.

Credit card payments are made via the Stripe.com secure banking platform.

PayPal payments are secure and guaranteed by PayPal.
Soap Hill reserves the right to suspend or cancel any execution of an order and/or delivery, regardless of its nature and level of execution, in the event of non-payment or partial payment of any sum due by the purchaser, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the website www.lacollineauxsavoirs.fr.

Penalties of an amount applicable automatically, to amounts unpaid at the end of a period of ten days following the date of payment or upon notification of the rejection of bank payment for any other means of payment. The delivery of any new order may be suspended in the event of late payment or partial payment of a previous order, notwithstanding the provisions hereof.

As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party authorized by law or designated by  Soap Hill for the sole purpose of verifying the identification of the buyer, the validity of the order, the method of payment used and the delivery envisaged.

Product Warranty

Legal dispositions :

When acting as a legal guarantee of conformity, the consumer has a period of two years from the delivery of the goods to act; he can choose between repairing or replacing the good, subject to the cost conditions provided for in article L.217-9 of the Consumer Code, except for second-hand goods, he is exempt from proving the existence the lack of conformity of the good during the six months following the delivery of the good, period extended to 24 months from March 18, 2016.

The legal guarantee of conformity applies independently of any commercial guarantee granted.

The consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code; in the event of an implementation of this guarantee, the buyer has the choice between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code. He has a period of two years from the discovery of the defect.

The postponement, suspension or interruption of the limitation cannot have the effect of extending the extinctive limitation period beyond twenty years from the day the right arises in accordance with article 2232 of the Civil Code.

All items acquired on this site benefit from the following legal guarantees, provided for by the Civil Code;

 

Legal guarantee of conformity:

According to Articles L.217-4 et seq. of the Consumer Code, the Seller is required to deliver goods that comply with the contract concluded with the Consumer Customer and to respond to any lack of conformity existing during the delivery of the Product. The guarantee of conformity may be exercised if a defect were to exist on the day of taking possession of the Product. However, when the defect appeared within 24 months following this date (or within 6 months if the order was placed before March 18, 2016 or the Product is sold second-hand), it is presumed to fulfill this condition. But, in accordance with article L.217-7 of the Consumer Code, "the Seller may combat this presumption if it is not compatible with the nature of the [Product] or the alleged lack of conformity".

On the other hand, after this period of 24 months (or 6 months if the order was placed before March 18, 2016 or the product is sold second-hand), it will be up to the Customer to prove that the defect existed at the time of taking possession of the Product. In accordance with article L.217-9 of the Consumer Code: “in the event of a lack of conformity, the buyer chooses between the repair and the replacement of the good. However, the seller may not proceed according to the choice of the buyer if this choice entails a manifestly disproportionate cost with regard to the other method, taking into account the value of the good or the importance of the defect. He is then required to proceed, unless this is impossible, according to the method not chosen by the buyer”.

 

Legal warranty against hidden defects:

According to articles 1641 to 1649 of the Civil Code, the Customer may request the exercise of the guarantee against hidden defects if the defects presented did not appear during the purchase, were prior to the purchase (and therefore did not result from normal wear and tear of the Product, for example), and are sufficiently serious (the defect must either render the Product unsuitable for the use for which it is intended, or reduce this use to such an extent that the buyer would not have purchased the Product or would not have bought it at such a price if he had known about the defect).

Complaints, requests for exchange or reimbursement for a non-compliant Product must be made by post or by email to the addresses indicated in the legal notices of the site.

In the event of non-compliance of a Product delivered, it may be returned to the Seller who will exchange it. If it is impossible to exchange the Product (obsolete Product, out of stock, etc.) the Customer will be reimbursed by check or transfer of the amount of his order. The costs of the exchange or refund procedure (in particular the shipping costs for returning the Product) are then borne by the Seller.

 

Disputes

This contract is subject to French law. La Colline aux Soaps cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from the misuse of the products marketed. The liability of La Colline aux Savons will be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have persisted despite all the precautions taken in the presentation of the products. 
In the event of a dispute or complaint, the consumer will first contact La Collines to obtain an amicable solution. In a second step and in the event of an appeal, the consumer may file a complaint with his district court.
